❶ 零售商促銷行為管理辦法的管理辦法
第一條為了規范零售商的促銷行為,保障消費者的合法權益,維護公平競爭秩序和社會公共利益,促進零售行業健康有序發展,根據有關法律法規,制定本辦法。
第二條零售商在中華人民共和國境內開展的促銷活動適用本辦法。
第三條本辦法所稱零售商是指依法在工商行政管理部門登記注冊,直接向消費者銷售商品的企業及其分支機構、個體工商戶。
本辦法所稱促銷是指零售商為吸引消費者、擴大銷售而開展的營銷活動。
第四條零售商開展促銷活動應當遵循合法、公平、誠實信用的原則,遵守商業道德,不得開展違反社會公德的促銷活動,不得擾亂市場競爭秩序和社會公共秩序,不得侵害消費者和其他經營者的合法權益。
第五條零售商開展促銷活動應當具備相應的安全設備和管理措施,確保消防安全通道的暢通。對開業、節慶、店慶等規模較大的促銷活動,零售商應當制定安全應急預案,保證良好的購物秩序,防止因促銷活動造成交通擁堵、秩序混亂、疾病傳播、人身傷害和財產損失。
第六條零售商促銷活動的廣告和其他宣傳,其內容應當真實、合法、清晰、易懂,不得使用含糊、易引起誤解的語言、文字、圖片或影像。不得以保留最終解釋權為由,損害消費者的合法權益。
第七條零售商開展促銷活動,應當在經營場所的顯著位置明示促銷內容,促銷內容應當包括促銷原因、促銷方式、促銷規則、促銷期限、促銷商品的范圍,以及相關限制性條件等。
對不參加促銷活動的櫃台或商品,應當明示,並不得宣稱全場促銷;明示例外商品、含有限制性條件、附加條件的促銷規則時,其文字、圖片應當醒目明確。
零售商開展促銷活動後在明示期限內不得變更促銷內容,因不可抗力而導致的變更除外。
第八條零售商開展促銷活動,其促銷商品(包括有獎銷售的獎品、贈品)應當依法納稅。
第九條零售商開展促銷活動應當建立健全內部價格管理檔案,如實、准確、完整記錄促銷活動前、促銷活動中的價格資料,妥善保存並依法接受監督檢查。
第十條零售商開展促銷活動應當明碼標價,價簽價目齊全、標價內容真實明確、字跡清晰、貨簽對位、標識醒目。不得在標價之外加價出售商品,不得收取任何未予明示的費用。
第十一條零售商開展促銷活動,不得利用虛構原價打折或者使人誤解的標價形式或價格手段欺騙、誘導消費者購買商品。
第十二條零售商開展促銷活動,不得降低促銷商品(包括有獎銷售的獎品、贈品)的質量和售後服務水平,不得將質量不合格的物品作為獎品、贈品。
第十三條零售商開展有獎銷售活動,應當展示獎品、贈品,不得以虛構的獎品、贈品價值額或含糊的語言文字誤導消費者。
第十四條零售商開展限時促銷活動的,應當保證商品在促銷時段內的充足供應。
零售商開展限量促銷活動的,應當明示促銷商品的具體數量。連鎖企業所屬多家店鋪同時開展限量促銷活動的,應當明示各店鋪促銷商品的具體數量。限量促銷的,促銷商品售完後應即時明示。
第十五條零售商開展積分優惠卡促銷活動的,應當事先明示獲得積分的方式、積分有效時間、可以獲得的購物優惠等相關內容。
消費者辦理積分優惠卡後,零售商不得變更已明示的前款事項;增加消費者權益的變更除外。
第十六條零售商不得虛構清倉、拆遷、停業、歇業、轉行等事由開展促銷活動。
第十七條消費者要求提供促銷商品發票或購物憑證的,零售商應當即時開具,並不得要求消費者負擔額外的費用。
第十八條零售商不得以促銷為由拒絕退換貨或者為消費者退換貨設置障礙。
第十九條鼓勵行業協會建立商業零售企業信用檔案,加強自律,引導零售商開展合法、公平、誠實信用的促銷活動。
第二十條單店營業面積在3000平方米以上的零售商,以新店開業、節慶、店慶等名義開展促銷活動,應當在促銷活動結束後15日內,將其明示的促銷內容,向經營場所所在地的縣級以上(含縣級)商務主管部門備案。
第二十一條各地商務、價格、稅務、工商等部門依照法律法規及有關規定,在各自職責范圍內對促銷行為進行監督管理。對涉嫌犯罪的,由公安機關依法予以查處。
第二十二條對違反本辦法規定的行為任何單位和個人均可向上述單位舉報,相關單位接到舉報後,應當依法予以查處。
第二十三條零售商違反本辦法規定,法律法規有規定的,從其規定;沒有規定的,責令改正,有違法所得的,可處違法所得3倍以下罰款,但最高不超過3萬元;沒有違法所得的,可處1萬元以下罰款;並可予以公告。
第二十四條各省、自治區、直轄市可結合本地實際,制定規范促銷行為的有關規定。
第二十五條本辦法由商務部、發展改革委、公安部、稅務總局、工商總局負責解釋。
第二十六條本辦法自2006年10月15日起施行。

山東省明碼標價管理辦法
第一章 總則
第一條 為規范價格和收費行為,專建立公開、公屬平、合法的市場價格秩序,維護經營者和消費者的合法權益,禁止價格欺詐,根據《中華人民共和國價格法》、《關於商品和服務實行明碼標價的規定》、《禁止價格欺詐行為的規定》、《零售商促銷行為管理辦法》等法律、法規和規章制定本辦法。
第二條 凡在山東省行政區域內發生收購和銷售商品或提供服務的價格行為,應當按照本辦法實行明碼標價。
明碼標價的方式由省級政府價格主管部門統一規定,縣級以上人民政府價格主管部門的價格監督檢查機構負責監制,並標明「價格舉報電話12358」。
第三條 本辦法所稱明碼標價是指經營者收購、銷售商品和提供服務時按照有關規定公開標示商品價格、服務收費標準的行為。
明碼實價是指經營者按照所公開標示的價格(標准)與消費者或其他經營者進行結算的行為。
明碼議價是指經營者以標明的價格(標准)為最高參考價,同消費者或其他經營者商議後確定交易價格的行為。
